IMPORTANT NOTICE: Some job applications may require you to complete an AI-powered voice interview. When you participate in an AI interview, we collect and process:
- Voice Recordings: Audio recordings of your interview responses
- Voice Characteristics: Pitch, tone, speaking pace, and other voice features (this may constitute biometric data under certain laws)
- Transcriptions: Text versions of your spoken responses
- Response Timing: How long you take to answer questions

4. How We Share Your Information

When you apply for a job through our Platform, YOUR APPLICATION DATA IS SHARED DIRECTLY WITH THE EMPLOYER. Once shared, the employer controls how they use your information, and they are responsible for their own compliance with employment and privacy laws. We are not responsible for how employers use your data after it is shared with them.
4.1 With Employers
When you apply for a job, we share with the employer:
- Your resume, cover letter, and application materials
- Contact information (name, email, phone)
- AI interview recordings and transcriptions (if applicable)
- AI-generated assessments and competency scores
- Any other information you provide in your application
Important: Once your information is shared with an employer, it becomes subject to the employer's own privacy practices. We recommend reviewing the employer's privacy policy. Vesta AI is not responsible for how employers use, store, or protect your information after it is shared with them.
4.2 With Service Providers
We share information with third-party service providers who help us operate the Platform:
- Cloud hosting and storage providers
- AI and speech processing services
- Email delivery services
- Analytics and performance monitoring
- Payment processors (if applicable)
These providers are contractually required to protect your information and use it only for the services they provide to us.
4.3 Legal Requirements and Business Transfers
We may share your information:
- To comply with laws, regulations, court orders, or government requests
- To protect our rights, property, or safety, or that of others
- To prevent fraud, security issues, or illegal activity

6. Your Rights and Choices
6.1 Access and Correction
You can access and update your account information, resume, and profile at any time through your account settings.
6.2 Data Deletion
You may request deletion of your account and personal information by emailing privacy@vestajobs.com. Please note:
- We will delete or anonymize your data within 30 days, subject to legal retention requirements
- Some data may be retained for legal compliance, fraud prevention, or dispute resolution
- AI interview data used for training may be retained in anonymized form
- Data already shared with employers cannot be deleted by us—you must contact the employer directly
- Deletion may prevent us from defending against legal claims
6.3 Data Portability

6.4 Opt-Out of Marketing
You can opt out of marketing emails by clicking "unsubscribe" in any marketing email or updating your communication preferences in your account settings. Note: You will still receive essential service-related emails (application updates, account notifications, etc.).
6.5 Withdraw Application
You can withdraw your application through your account dashboard. However, once an employer has received your application data, we cannot delete it from their systems—you must contact the employer directly.

7. AI Interview Transparency and Your Rights
7.1 How AI Interviews Work
Our AI interview system:
- Records your voice responses to pre-set questions
- Transcribes your spoken words into text
- Analyzes communication patterns, vocabulary, and response quality
- Generates competency scores and hiring recommendations
7.2 AI Limitations and Disclaimers
⚠️ Important: AI Is Not Perfect
Our AI system is a tool that provides recommendations only. AI assessments may contain inaccuracies, biases, or errors. The AI does not make hiring decisions—employers make all final hiring decisions based on multiple factors.
We continuously work to improve fairness and accuracy, but no AI system is perfect. You have the right to request human review of AI assessments in jurisdictions where required by law.
7.3 Non-Discrimination Commitment
Our AI does not intentionally consider protected characteristics such as race, gender, age, disability, national origin, religion, or other protected classes. However:
- Voice characteristics analyzed by AI may correlate with protected characteristics
- We cannot guarantee complete elimination of all potential bias
- Employers are solely responsible for ensuring their hiring practices comply with anti-discrimination laws
7.4 Right to Human Review
If you believe an AI assessment was inaccurate or unfair, you may request human review by contacting the employer directly. Vesta AI provides technology services but does not make hiring decisions or conduct human reviews of employer hiring choices.
8. State-Specific Disclosures
8.1 Illinois Residents (BIPA)
Under the Illinois Biometric Information Privacy Act (BIPA), we notify Illinois residents:
- We collect voice recordings and voice characteristics (biometric identifiers)
- Purpose: To conduct AI-powered interviews and generate candidate assessments
- Retention: At least 3 years, may be kept indefinitely for AI training
- We will not sell, lease, or trade your biometric data
- Your biometric data is stored using reasonable security measures
- You must provide written consent before we collect biometric data
8.2 New York Residents
Under New York laws regulating automated employment decision tools:
- We use AI to assess candidates for job positions
- AI assessments are recommendations only; employers make final decisions
- We have conducted bias audits of our AI system (results available upon request)

- Vesta AI acts as the data controller for your account and profile information
- When you apply to a job, the employer becomes the data controller for your application data
- Vesta AI acts as a data processor on behalf of the employer for application processing
9.2 Legal Basis for Processing
We process your data based on:
- Consent: For AI interviews and biometric data collection
- Contractual Necessity: To provide job application services
- Legitimate Interest: To improve our Platform and AI models, prevent fraud
- Legal Obligation: To comply with applicable laws
9.3 GDPR Rights
EEA users have rights under Articles 12-23 of the GDPR:
- Right to access your personal data
